H1B1 is a really different H1B visa

US Chile embassy explains that:

"The H1B1 visa is similar to the H1B work visa program, with notable differences that make the H1B1 application process easier. The H1B requires that employers and visa applicants be approved by the U.S. Citizenship and Immigration Services (USCIS) prior to the visa interview. This process includes the issuance of the I-797 form and is subject to a time limit of continuous work in the U.S. Although there is a cap on the total number of H1B1 visas which can be issued annually, there is no time limit and the visa can be renewed multiple times. No other approval is required to qualify for the H1B1 visa besides the ETA-9035 - USCIS is not involved in the process. H1B1 visa holders may switch to an H1B visa on future applications, and vice versa". A certified form ETA-9035 or ETA-9035E filed with the U.S. Department of Labor. This form may be found at the Department of Labor's H1B1 website and should be completed by the employer. Fill ETA-9035 or ETA-9035E from https://www.foreignlaborcert.doleta.gov/preh1bform.cfm and that it is all !!!!           

                            How Much Will Sponsoring an H1-B Visa Cost an Employer?

An H-1B Visa (or H-1B transfer) will cost you around $5000 (including government fees). Immigration lawyer fees should costs $2000 to $3000, while filing fees are around $3000. An employer must have enough money in the bank necessary to pay the H1B employee's salary for a reasonable period of time.

The US-Chile Free Trade Agreement which took effect on January 1, 2004 created a new class of non-immigrant work visa for chilean citizens called the H1B1 chilean visa. The H1B1 Chilean visa allows qualified Chilean citizen to live and work in the US and to be accompanied by their spouse and dependent children.

H1B1 Chilean visa applicants must first have a confirmed job in a specialty occupation from a US employer willing to sponsor their visa. H1B1 Chilean visas applicants must meet the following criteria:

  • Position must be a specialty occupation; that is, a position requiring theoretical and practical application of a body of specialized knowledge. Examples of specialty occupations are jobs in the fields of engineering, mathematics, physical sciences, computer sciences, medicine and health care, education, biotechnology, and business specialties, such as management and human resources;
  • Applicant must have a post-secondary degree involving at least four years of study in his or her field of specialization. In some instances, a combination of specialized training and experience can constitute alternative credentials;
  • Applicant cannot be self-employed or an independent contractor; and
  • Period of employment in the US must be temporary. As such, the H1B1 Chilean visa applicant must demonstrate non-immigrant intent. This requirement makes the H1B1 Chilean visa different from the traditional H1B work visa. H1B work visa applicants do not have to demonstrate that they intend to return to their country when their temporary job is finished. Note that Chilean citizens are still eligible to apply for traditional H1B visas as well. H1B Chilean visa applicants must have a job offer from a US employer willing to sponsor the visa before contacting us for assistance.  

              H1B1 visa: better than H1B. By far.

Unlike the H-1B visa there is no requirement for a Petition for Nonimmigrant worker to be approved by the United States Citizenship and immigration Services. The candidate can apply for a H1B1 visa directly at the US Consulate in his or her home country by submitting the appropriate nonimmigrant visa application along with a detailed employment offer letter, a Labor Condition Application (LCA) certified by the Department of Labor, and the relevant supporting documents.

Due to the limited availability of H-1B visas, employers may find it useful to consider filing H1B1 petitions for eligible candidates. Filing H1B1 visa petitions does not preclude citizens of Chile and Singapore from applying for a regular H-1B visa petition..
